Why ESOS compliance is essential

The Energy Saving Opportunity Scheme (ESOS) is a mandatory government scheme which affects up to 10,000 United Kingdom organisations.

The scheme has been designed to increase awareness of energy consumption to make it easier for businesses to act, to lower their energy bills and reduce carbon emissions across the UK.

 

What is ESOS phase 3?

The scheme runs in 4 year phases. Phase 2 closed in December 2019, and it is now in Phase 3.  The deadline for compliance is 5 December 2023. ESOS requires all large businesses to produce reports on energy usage and efficiency every four years. ESOS is a mandatory government scheme which affects up to 10,000 United Kingdom organisations.

Who is affected by ESOS?

ESOS applies to organisations for which one or more of the following criteria apply:

  • Employ 250 or more people
  • Have an annual turnover in excess of €50 million (£44 million) and an annual balance sheet total of over €43 million (£38 million).

If you’re very close to the qualification threshold in either direction, or if the size of the business has changed substantially in the past few years, you should check the full government guidance with ESOS.

 

What you need to do:

Organisations that qualify for ESOS must carry out ESOS assessments every four years. ESOS assessments are audits of the energy used by buildings, industrial processes and transport to identify cost-effective energy saving measures. There are threats of large fines for non-compliance.

Q – I’m close to the qualification threshold – what should I do?

A – If you’re very close to the qualification threshold in either direction, or if the size of the business has changed substantially in the past few years, you should check the full government guidance with ESOS.

Q – When is the deadline for assessing whether or not I qualify for ESOS?

A – 31 December 2022; if your company meets the conditions for ESOS on that date, you must comply

Q – My business qualified for ESOS phase 2 but doesn’t qualify for phase 3 – what should I do?

A –  You must inform the Environment Agency (the administrator for the scheme) by emailing ESOS@environment-agency.gov.uk .

Q – I have an ISO 50001 certification, do I need to carry out an assessment?

A – If you have an ISO 50001 energy management system that’s certified by an accredited certification body and covers all your energy use as defined under ESOS (for the whole corporate group in the UK), this counts as your ESOS assessment. If not you will still need to have an assessment.

Q – I am an international company do I need an ESOS?

A – If you employ more than 250 people across the UK, Yes
